Corporate Reorganization in Bankruptcy
Addresses both the practice and theory of corporate reorganization under chapter 11 of the Bankruptcy Code. Roles of parties in chapter 11; operating business in a pending case; turning the business around; determining claims against the estate; restructuring debts and dividing the value of a business, including standards for approval of disclosure statements and confirmation of plans of reorganization; ethical issues raised in reorganization context. The practical component of this course employs simulation exercises involving a hypothetical chapter 11 debtor-corporation-negotiation. Drafting, and other lawyering skills are all emphasized.Type: SEM
