Federalist Society: Debate with Charles Fried regarding Federal Preemption

George Conk debated Professor Charles Fried, the former Solicitor General (1985-1989) at an event sponsored by the Fordham Chapter of the Federalist Society on March 26, 2009. Professor Nicholas Johnson moderated. The topic was federal preemption of state tort law, which was addressed twice this term by the U.S. Supreme Court - in Altria v. Goode (allowing the `Light Cigarettes' consumer fraud class actions to proceed) and affirming a Vermont plaintiff's verdict in Wyeth v. Levine (a failure-to-warn pharmaceutical product liability case).
